Tenure and Possession
The land is sold subject to an annual grazing license which expires on the 31st of December 2011.
Sporting and Mineral Rights
It is understood that the sporting rights are included with the property.
It is understood that the mineral rights are reserved to a third party.
The land is shown red on the attached plan for identification purposes only. The purchaser of the land will be responsible for the maintenance of all boundaries.
Rights and Easements
The property is sold subject to and with the benefit of all rights of way, water, drainage, water courses, and other easements, quasi or reputed easements and other rights of adjoining owners if any, affecting the same and all existing or proposed wayleaves or other matters registered by any competent authority subject to statue.
Two electricity pylons cross the property and it is understood the vendor receives an annual wayleave payment which will be transferred to the purchaser upon completion. A copy of the wayleave agreement is available from the Agent upon request.
Single Payment Scheme
The land is sold with the benefit of entitlements to receive payments under the Single Payment Scheme. Currently the vendor has 13.18 non SDA entitlements with a 2010 unit value of £273.7 which they will include within the sale if the purchaser wishes.
The vendor will undertake to transfer entitlements to the purchaser in accordance with the regulations of the scheme upon completion. The purchaser will be liable for a charge of £350 + VAT for the transfer of the entitlements. The contract of sale will oblige the purchaser to sign an indemnification so they will retain the land in good agricultural and environmental condition and follow the Single Payment Scheme cross compliance regulations. Further to this the indemnification will also hold the purchaser liable should the vendor be penalised for breech of cross compliance.
Entry Level Stewardship
The property is sold subject to an Entry Level Stewardship agreement which includes a range of land based management options and expires in 2016. A copy of the agreement is available from the agent upon request.
